CogniAtlas Terms of Use (EULA)

These Terms of Use and End User License Agreement ("Terms") govern your use of CogniAtlas. By downloading, installing, or using the app, you agree to these Terms.

CogniAtlas ("the App") is provided by M365 Services Corp ("we", "us", "PowerM365"). The App is a mind-mapping and study tool for web, desktop, and mobile.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal or internal business use, in accordance with these Terms and the rules of the app store you obtained it from. This license does not transfer ownership of the App to you.

2. App Store Terms & Apple Standard EULA

If you obtained the App from the Apple App Store, Apple's Licensed Application End User License Agreement (Standard EULA) also applies to your use of the App and is incorporated into these Terms by reference. To the extent these Terms conflict with Apple's Standard EULA, Apple's Standard EULA governs for App Store distributions. Apple is not a party to these Terms and is not responsible for the App or its content; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. If you obtained the App from Google Play, the Microsoft Store, or another distributor, that platform's terms also apply.

3. CogniAtlas Pro Subscription

Core mapping is free. Optional Pro features are available through an auto-renewable subscription, "CogniAtlas Pro":

Prices may vary by region and are shown in the App before purchase. Payment is charged to your app-store account (e.g., your Apple Account) at confirmation of purchase. The subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription in your app-store account settings after purchase. Refunds, where applicable, are handled by the app store under its policies and are subject to applicable law.

4. Acceptable Use

You agree not to misuse the App, including: reverse engineering, decompiling, or disassembling the App except where permitted by law; reselling, redistributing, or sublicensing the App; using the App to violate any law or the rights of others; or attempting to bypass security, licensing, or payment mechanisms.

5. Your Content

You retain ownership of the maps, notes, drawings, images, and files you create or import ("Your Content"). CogniAtlas is local-first: Your Content is stored on your device and in folders you choose, and we do not require an account or upload Your Content to our servers to operate the App. You are responsible for Your Content and for keeping your own backups. 6. Intellectual Property

The App, its software, design, branding, and related materials are owned by M365 Services Corp or its licensors and are protected by law. See our Copyright Notice. Third-party software, fonts, and components remain subject to their own licenses.

7. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data will never be lost. You are responsible for maintaining backups of Your Content.

8. Limitation of Liability

To the maximum extent permitted by law, M365 Services Corp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App or subscription in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Changes & Termination

We may update these Terms from time to time; material changes will be reflected by updating the date below and, where appropriate, an in-app notice. Continued use of the App after changes means you accept the updated Terms. We may suspend or terminate the license if you materially breach these Terms; you may stop using the App at any time. Sections that by their nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability) survive termination.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which M365 Services Corp is established, without regard to conflict-of-laws rules, except where mandatory local consumer-protection law applies to you.
